Our core area of practice in real estate transactions includes due
diligence on property titles, usually before drafting purchase sales
agreements and definitely before executing title conveyances. We first
take a hard look at issues many non – Costa Rican buyers take for
granted as transparent in their home countries, such as clear road
access, utilities, environmental law limitations, land use regulations,
building regulations, de facto possession, and possible boundary
conflicts, among others. Then we recommend using third party trust
account and escrow services to retain control of the transaction until
closing. Construction contracts can included as a follow up or as part
of the property purchase process.
We assist with real estate investments as part of purchasing or starting
a business in Costa Rica also. We recommend joint venture investments or
business acquisitions with partnership agreements and corporate
structures that allow for different degrees of control and/or management
flexibility. Our basic advice includes tax strategy, labor relations,
and banking practices for our clients with a new or existing business in
mind.
For the investor interested in developing a real property we offer
setting up Covenants, Conditions & Restrictions, usually in the form of
conservation easements and/or land use restrictions recorded on titles,
as well as property splits, utility easements and home owner
associations.
Legal Residency in Costa Rica is an area in which we offer our clients
complete services such that they do not have to deal with government
bureaucracy in CR on their own. A careful analysis of each client’s
situation is always done before recommending options for legal
immigration to Costa Rica. We help in dealing with consular
documentation for applications and guide our clients through the entire
process until obtaining temporary or permanent residency status.
